Certificates

What they are

Besides translation certificates, the notary may certify any facts they witness, recording how those facts came to their knowledge.

Article 4(4)(a) of the Notarial Statute gives notaries authority to issue certificates of life and identity, of the holding of public office, of the management or administration of legal persons, and of other facts they have verified.

Full evidential weight

A certificate is an authentic document and carries full evidential weight, which can only be displaced by proving it false.

Certificates are notarial acts within the notary’s exclusive authority.

In practice

The practical uses of this kind of document are very varied: the notary may certify facts they witness, such as the content of a website, an email or a text message, the state of building works, that a person is alive and their identity, that they hold a particular office, or that a contract was not signed because a particular person did not attend.

Certificates relating to European public limited companies are a further example of certificates issued by the notary.
