Documents issued in Portugal for use abroad

Apostille

The apostille is a formality certifying the authenticity of public documents issued in one State for use in another, giving them formal evidential weight. It applies to States that have acceded to the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents, concluded at The Hague on 05/10/1961.

Each country designates its own competent authority.

Which documents are apostilled

Documents issued by notarial practices, registries, courts, government ministries, municipal councils, parish councils and educational establishments are legalised by apostille.

Public documents issued by an EU Member State for use in another EU country — such as certificates of birth, parentage, adoption, marriage, divorce, domicile, residence, nationality or criminal record — are exempt from the apostille (and from legalisation) under Regulation (EU) 2016/1191.

A multilingual standard form may be requested alongside the public document, to avoid the need for a sworn translation of the original.

Where a country accepts certified copies, the destination country must accept a copy made in the country where the document originated.

Competent authority

The central authority in Portugal for issuing and verifying apostilles is the Prosecutor General (Procurador-Geral da República). That authority is also exercised, by delegation, by the District Prosecutors General of Porto, Coimbra and Évora, and by the public prosecutors heading the district prosecution offices in Funchal and Ponta Delgada.

Law 69/2023 of 7 December, which amended article 4(4)(i) of the Notarial Statute, gave notaries authority to legalise documents by affixing apostilles, on terms to be set by order of the member of Government responsible for justice, which has not yet been published.
