By law, the notary only executes acts requiring the presence of the parties within the boundaries of the municipality of Lisbon, but will travel within those boundaries by prior appointment.

Signature certifications

What they are

Besides powers of attorney and contracts, signatures are often certified on travel authorisations, on undertakings of responsibility allowing a foreign national to enter Portugal, and on declarations of every kind.

Notarial staff with delegated authority may sign certifications.

For the notary to certify a signature, the following are required:

  • That she is able to read the document;
  • That the document is written in English, French or Spanish or, if in another language, that it is translated for her by an expert of her choosing;
  • That the document is not blank, written or signed in pencil, or in materials that do not guarantee permanence and durability;
  • That the signatory produces a valid identity document.

Certification in person, for an individual

Certifications for an individual acting in their own name are always done in person. Either the signature alone, or the handwriting and the signature, may be certified, depending on the form the law requires for the act.

People who cannot or are unable to sign

If the person whose signature is to be certified cannot sign, they must be accompanied by another person of their choosing who signs the document on their behalf.

This is known as certification at the signatory’s request (a rogo).

Travel authorisations for minors

Minors may only enter or leave Portugal accompanied by a person holding parental responsibility, or with an authorisation given by such a person and certified by a notary, granting authority to the other parent or to a named third party to accompany the minor.

The authorisation may be used any number of times within the validity period it states, which may never exceed one year. If no period is stated, it is treated as having been given for six months.

Undertakings of responsibility

This document is signed by someone declaring that they take responsibility for a foreign national wishing to enter Portugal, as regards the conditions of their stay in the country, the costs of removal if necessary, and compliance with Portuguese law.

We draft the wording of undertakings of responsibility to suit your circumstances, and certify in person the signature of the person taking responsibility for the foreign national’s entry into Portugal.

Certification in person or by comparison, acting as a representative

Signatures of representatives (attorneys, managers, directors) may be certified either in person or simply by comparing the signature on the document with the signature on an identity document or an authenticated copy of one.

Which method is used depends on the form the law requires for the document in question.

The power of attorney or the commercial registry certificate must also be produced, as the case may be, and in certain situations a set of minutes as well.
